Australian federal court warns lawyers over ‘unacceptable’ use of AI

The Federal Court of Australia has issued new guidelines cautioning legal professionals against the improper use of generative AI in legal proceedings. Chief Justice Debra Mortimer emphasized that presenting false or inaccurate information generated by AI is unacceptable and undermines the responsibility to not mislead the court. The guidelines advise lawyers to verify AI-generated content, especially in pleadings and submissions, and to disclose any use of AI at the beginning of documents. Failure to adhere to these rules may result in consequences such as adverse cost orders and breaches of professional obligations.
