Two EU countries probe AI Act’s bans, but legal challenges loom

It is reported that two EU countries have already launched investigations into six potential violations of the AI Act’s prohibitions, only a few weeks after the bans took legal effect. These investigations have begun despite the law’s penalty regime not taking effect until August 2025 and enforcement powers not being granted until August 2026. This misalignment in the AI regulation timeline could lead to legal challenges if fines are issued before the enforcement chapter is legally effective. The European Commission has acknowledged potential legal uncertainties and is still “looking into ways to provide more certainty in a legally sound way.”
