The Minister for Communications has tabled the Report of the Statutory Review of the Online Safety Act. The independent review examined the operation and effectiveness of the Act and considered whether additional protections are needed to combat online harms, including those posed by emerging technologies. The report makes 67 recommendations to strengthen Australia’s online safety laws, including the introduction of a new duty of care on online service providers, changes to existing complaints schemes for those experiencing online harms, stronger penalties for non-compliance, increased transparency requirements for online services, and changes to governance arrangements for the Office of the eSafety Commissioner. In relation to AI, the report notably recommends the inclusion of generative AI services in the regulated category of “online platforms”, as well as the inclusion of certain AI generated material in a reformed ‘Class 1’ category (i.e. illegal and seriously harmful material).
