The Office of the Australian Information Commissioner (OAIC) has conducted a desktop review of 23 government agencies authorised to use automated decision-making (ADM) under various legislative statutes. The review assessed how these agencies disclose their use of ADM as ‘operational information’ required to be published under the Freedom of Information Act 1982 (FOI Act). The OAIC identified opportunities for improvement in transparency, emphasising that clear communication about ADM enhances integrity, accountability, and public trust. The OAIC now plans to update the Information Commissioner Guidelines to explicitly include ADM as an example of ‘operational information’ under the Information Publication Scheme (IPS). This initiative aims to ensure agencies meet their obligations to proactively publish information, thereby strengthening public confidence in government decision-making processes.
