ICT Ministry clarifies enforcement approach of AI Basic Act

At an explanatory session in preparation for the enforcement of the ‘AI Basic Act’, officials of the Ministry of Science and ICT clarified that the AI Basic Act – which is set to take effect on 22 January 2026 – will be “applied cautiously within the minimum necessary scope.” Ministry officials further clarified: (1) that the one-year grace period may be extended further, considering trends in the European Union (EU) and other regions; (2) during the grace period, fact-finding investigations will only be conducted exceptionally in cases of national damage such as loss of life or serious human rights violations; (3) the scope of “high-impact AI,” a contentious issue, will also be set minimally and reviewed carefully; (4) to reduce administrative burdens on businesses, the deadline for determining whether AI falls under the “high-impact” category is set at 30 days, with a single extension allowed; (5)before the law’s implementation, the government plans to finalize the enforcement decree and guidelines by incorporating gathered opinions; and (6) a provisional “AI Safety and Trust Support Desk” involving relevant agencies and legal experts will be set up to actively respond to inquiries from businesses regarding legal interpretations and compliance obligations through a homepage and FAQ section.
