Garante fines AI company Replika’s developer $5.6 million

Italy’s data protection agency (the Garante) has fined the developer of AI chatbot company Replika 5 million euros ($5.64 million) for breaching rules designed to protect users’ personal data. The Garante identified violations of regulations in February 2023, leading to the suspension of the “Replika” application. The Garante found that Replika had not established legal bases for processing operations as of 2 February 2023, and lacked mechanisms to verify user age during registration and usage, despite claiming to exclude minors. Technical assessments revealed ongoing deficiencies in the age verification system. Consequently, the Garante imposed sanctions and ordered the company to align its operations with regulatory requirements.
