The European Union is progressing with compliance guidance for its landmark Artificial Intelligence Act and is now inviting public input through an official consultation. This move is part of the EU’s effort to refine its approach to AI regulation, ensuring clarity and practicality as the legislation moves closer to implementation.
Key Areas of Consultation
The EU’s consultation seeks input from AI industry professionals, academics, businesses, and civil society on two critical aspects:
- Defining AI Systems
The consultation asks for feedback on the Act’s definition of AI systems, particularly how it differentiates from “simpler traditional” software. Respondents are encouraged to provide real-world examples of software they believe should fall outside the scope of the regulation. - Prohibited AI Uses
The consultation places significant focus on banned uses of AI, categorized as “unacceptable risk.” Examples include China-style social scoring and other applications that could undermine fundamental rights. The EU is seeking practical examples to clarify how these prohibitions might apply in real-world scenarios.
A Path Toward Clearer Regulation
The consultation remains open until December 11, 2024, offering stakeholders ample time to share their insights. The European Commission has stated in a press release that it plans to publish detailed guidance on AI system definitions and banned applications in early 2025.
This marks another step in the EU’s effort to position itself as a global leader in AI regulation, balancing technological innovation with safeguarding fundamental rights.
