While the AI Act recognizes that processing sensitive data is sometimes necessary to detect and correct biases in AI systems, the GDPR’s restrictions on such data processing could hinder these efforts. By highlighting this tension, the document underscores the need for clarity to ensure that AI systems can be effectively monitored for discrimination without violating data protection laws.
