The Broadcasting, Media, and Communications Committee released a guide titled “Guide to Telecommunications-Related Laws on User Protection for Artificial Intelligence Service Providers,” aiming to clarify legal uncertainties stemming from advancements in AI technology. The guide (1) analyses key provisions of the Telecommunications Business Act and the Act on Promotion of Information and Communications Network Utilization and Information Protection, applying them to AI services; (2) explains that AI service providers, as value-added telecommunications business operators, must not engage in acts detrimental to user interests or fail to notify users of important matters, as prohibited under the Telecommunications Business Act; (3) examines the concept of “distribution” concerning the prevention of illegal and harmful information under the Act on Promotion of Information and Communications Network Utilization and Information Protection, noting that applicability may vary based on AI service usage; and (4) suggests improvements tailored to the AI service environment to ensure comprehensive user protection policies.
