The Personal Data Protection Department (JPDP) has introduced three new guidelines—Data Protection Impact Assessment (DPIA), Data Protection by Design (DPbD), and Automated Decision-Making and Profiling (ADMP)—to enhance proactive measures for data handlers, particularly regarding the use of AI in personal data processing. Personal Data Protection Commissioner Shariffah Rashidah Syed Othman emphasized that these guidelines are based on risk management and accountability, requiring organizations to understand the implications of data usage and take responsibility for their decisions. The guidelines aim to address challenges posed by AI and data analytics, ensuring human oversight to mitigate bias in decision-making processes. While the Act does not apply to government agencies, the JPDP is working to incorporate data protection measures in the public sector, with non-compliance penalties reaching up to RM100,000.
