This legislation seeks to ensure that US firms are given precedence over foreign adversaries, particularly those from arms-embargoed countries, in acquiring these critical technologies. For background, the GAIN AI Act was previously introduced as part of the National Defense Authorization Act, as a more direct successor to the recently rescinded Biden-era AI Diffusion Rule to address ongoing national security and supply chain concerns regarding advanced AI chips. The GAIN AI Act is now being introduced as standalone legislation rather than as an amendment to the National Defense Authorization Act.
